What’s Included

Unless otherwise noted, our tours include water refills, transportation, the services of a professional driver and guide, all sightseeing fees, activities, admissions, refreshments and meals, as listed in the itinerary.

Vehicles

We reserve the right to use leased equipment or to substitute a larger vehicle than originally ordered. Tour price may be subject to an additional fuel surcharge. We reserve the right to charge full-price minimums on group tours for all canceled vehicles and tours if canceled by the group within 30 days of the departure date. No smoking or alcoholic beverages are allowed aboard any vehicles.

Payment

We accept all major credit cards as well as corporate checks. Colorado Sightseer is the principal Colorado transportation operator and is responsible to all participants for all arrangements and for all tour and transportation services offered in your Sightseeing Tour Quotation.

Itinerary Changes

In the event of a change in the itinerary necessitated by factors beyond the control of Colorado Sightseer, no refund or credit will be allowed, provided that Colorado Sightseer provides accommodations and services of comparable quality. Any such change shall not modify any cancellation provision or policy. No credit will be allowed or refund given for any services provided in the Requested Itinerary should any such services not be utilized by tour members.

Injuries

Colorado Sightseer, its agents and employees shall not be responsible for personal injuries or property damage, loss, or delay, or change of itinerary incurred by any person or tour participant arising out of the act of negligence of any direct or supplemental carrier, hotel or other person rendering these tours; nor shall The Colorado Sightseer be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reasons of any event beyond the actual control of Colorado Sightseer, or of any agent or supplier.

Admission to Sites

Admission times and entry to all included sights depend on the timely participation by guest participants. There will not be any refunds or credits for missed activities due to lateness by guest participants on any tour.

The Colorado Sightseer Liability Waiver

Ullr Tours, LLC, a Colorado Limited Liability Company doing business as The Colorado Sightseer located at 600 S. Holly Street, Suite 200, Denver, CO 80246 (hereinafter “The Colorado Sightseer”). By booking a tour with us you agree and acknowledge that this waiver applies to you and also applies to anyone you are booking on behalf of and any minors that you are responsible for who are participating in any Activity. This Agreement applies to all participation in vehicle tours and/or additional activities, such as hiking, sightseeing, and photo opportunities, (collectively, the “Activities” or individually, each an “Activity”) offered by The Colorado Sightseer.

You agree that if you have any medical condition, you must speak with your medical provider prior to your participation in any Activity. The Colorado Sightseer is not responsible for accessing your medical condition for participation. By participating in any Activity, you agree and acknowledge that you are physically and medically able to participate. If at any time during the Activity you feel that you are unable to continue for any reason, it is your responsibility to alert your The Colorado Sightseer tour guide. Depending on the Activity, you and your The Colorado Sightseer guide will determine the best steps to address your situation.

You agree and understand that there is no right to privacy while you participate in an Activity. Further, you agree and acknowledge that both video and photographs may be taken at The Colorado Sightseer for marketing purposes and agree and acknowledge that you have granted The Colorado Sightseer the rights to use such video and photographs.

By participating in any Activity offered at The Colorado Sightseer, you agree and acknowledge that participation in any Activity naturally involves risk of injury, whether you or someone else causes it. Specific risks vary and the risks range from minor injuries to major injuries, such as catastrophic injuries. The typical injuries that may occur include suffering from altitude sickness, sunburns, bruises, muscle strains, and other injuries. In consideration of your participation in the Activity offered by The Colorado Sightseer, you understand and voluntary accept this risk and agree that The Colorado Sightseer, its owners, directors, employees, volunteers, agents, and independent contractors will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, economic loss or any damage to you resulting from any action of The Colorado Sightseer, including, but not limited to, the negligence of The Colorado Sightseer, anyone on The Colorado Sightseer’s behalf, and/or anyone participating in the Activity. Further, you agree, understand, and acknowledge that The Colorado Sightseer provides recreational services and may not be held liable for defective products. Further, you agree and acknowledge that The Colorado Sightseer is not liable for any injuries that occur while you are not in the vehicle or for any injuries that are caused by third parties while you are in the vehicle.

YOU AGREE AND ACKNOWLEDGE THAT THE LIMITATION OF LIABILITY FOR ALL REASON FOR ANY INJURIES THAT OCCUR IN DURING AN ACTIVITY WILL BE THE AMOUNT PAID BY THE COLORADO SIGHTSEER’S INSURANCE POLICY IN EFFECT AT THAT TIME OR THE AMOUNT PAID TO THE COLORADO SIGHTSEER FOR THE ACTIVITY, WHICHEVER IS GREATER.

Certain Activities involve additional risks. It is your responsibility to adhere to all instructions provided by your The Colorado Sightseer tour guide during all Activities. For example, outdoor Activities such as hiking and other outdoor Activities involves additional risks to your safety. While we take reasonable precautions to ensure your safety, the Colorado back country has wild animals (including bears, mountain lions, and snakes), changing weather conditions (including lightning, rain, and sun), and natural conditions (including steep trails, dislodged rocks, and potentially unsafe tree conditions).

The Colorado Sightseer does not provide any medicine or medical advice to our customers. We recommend that should you need anti-motion sickness medication, Epi-Pens or similar devices, or any other medication that you carry such medication on your person. This includes any medication that is needed for minors. Should you require any medical help during any Activity, you agree and acknowledge that you are solely responsible for the cost of that medical help, including transportation for medical reasons by ambulance if necessary.

Should you violate any rules or directives of The Colorado Sightseer or fail to follow the safety procedures, you may be asked to leave the Activity and no refund will be given. This includes The Colorado Sightseer may terminate the Activity in the middle of the Activity if you appear to be a risk to yourself, another participant, or The Colorado Sightseer personnel. If this does happen, you will be responsible for transportation from the time the Activity is terminated for you. You agree and acknowledge that The Colorado Sightseer may, in its sole discretion, immediately terminate an Activity if you appear to be under the influence of drugs and/or alcohol, including legal medications and marijuana (both medical and recreational) that affect your ability to safely participate in an Activity.

You agree and acknowledge that The Colorado Sightseer is not responsible for any of your personal belongings that you bring on an Activity. It is your responsibility to monitor all personal belongings that you bring on an Activity.

This agreement shall be interpreted according to the laws of Colorado. You agree to be subject to the personal jurisdiction of the District Court for Denver County, Colorado with respect to this Agreement.

Assumption of the Risk and Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by
the World Health Organization. COVID-19 is extremely contagious and is believed to
spread mainly from person-to-person contact. As a result, federal, state, and local
governments and federal and state health agencies recommend social distancing and
have, in many locations, prohibited the congregation of groups of more than 10 people.

The Colorado Sightseer has put in place preventative measures to reduce the spread of COVID-19; however, The Colorado Sightseer cannot guarantee that you will not become infected with COVID-19. Further, participating in The Colorado Sightseer Tour could increase your risk of contracting COVID-19.

By booking a tour with us you agree and acknowledge that this waiver applies to you and also applies to anyone you are booking on behalf of and any minors that you are responsible for who are participating in any Activity acknowledge the contagious nature of COVID-19 and voluntarily assume the risk I may be exposed to or infected by COVID-19 by participating in the tour and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 on the tour may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Colorado Sightseer Guides, and other tour participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole
responsibility for any injury myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with my participation in The Colorado Sightseer Tours.

On my behalf, and on behalf of the other participants in my booking, I hereby release, covenant not to sue, discharge, and hold harmless The Colorado Sightseer, its employees, guides, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this
release includes any Claims based on the actions, omissions, or negligence of The Colorado Sightseer, its employees, agents, independent contractors, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Colorado Sightseer Tour.

This agreement shall be interpreted according to the laws of Colorado. You agree to be subject to the personal jurisdiction of the District Court for Denver County, Colorado with respect to this Agreement.
